These Terms & Conditions (“terms”) govern your access to and use of our website www.thehairg.com and any purchase of our products in the united states. By using our site or purchasing from us, you agree to these terms. Please read them carefully. If you do not agree to these terms, do not purchase, receive or use our products, or access our site. 

THE HAIR GENERATION may modify or change these Terms & Conditions at any time and at our sole discretion. If there are material changes made we will provide notice of those changes by sending you an email notification or providing notice through our website. If you continue to access our site after such notice, you confirm your acceptance of the revised Terms & Conditions and all of the terms incorporated therein by reference. We encourage you to frequently review our terms and conditions when you access our website or order from us. 

Continued use of the Website or purchase of products after any changes constitutes your acceptance of the revised Terms & Conditions. 

Important Notice

These terms contain a mandatory individual arbitration and class action/jury trial waiver provision. This means that disputes between you and THE HAIR GENERATION LLC will be resolved through binding arbitration on an individual basis, and you waive any right to a jury trial or to participate in a class action.

By agreeing to these Terms & Conditions, you also acknowledge and agree that you may not use our products or website for any unlawful or unauthorized purpose, and that you will not, in your use of the website, violate any laws in your jurisdiction.

A breach or violation of any of these Terms may result in immediate suspension or termination of your access to our website and services.

We reserve the right to suspend or terminate access if you violate these Terms.

Products & Orders

Products descriptions, pricing and availability are subject to change without notice. The hair generation communicates accurate pricing and product information but will not be held responsible for any pricing, typographical, or other errors. We reserve the right to limit quantities or refuse any order. 

In the event that we make a change to or cancel an order, we may attempt to notify you by email and/or billing address or phone provided at the time of the order. Unless otherwise agreed, payment must be received before acceptance of an order. We can also process payment and ship parts of an order separately. We are not responsible for typographical errors in product descriptions. 

Resellers prohibited: we reserve the right to prohibit sales to dealers or resellers. For purpose of these Terms & Conditions, a reseller is anyone who purchases a product from the website for the purpose of engaging in commercial sale of the same product to a third party. Products you purchase may not be resold. 

Shipping

We ship within the United States mainland (Hawaii, Alaska and Puerto Rico are excluded). Delivery times are estimates and may vary. We are not responsible for delays caused by carriers or other factors beyond our control. You agree to pay any shipping and handling charges shown at the timw you make the purchase. We reserve the right to increase, decrease, add or eliminate shipping and handling sometimes, but we will provide notice of the charges to you before you make your purchase. 

Payments

Payments are processed securely through Shopify Payments. By submitting your payment details, you authorize THE HAIR GENERATION LLC to charge the full amount of your order, including any applicable taxes, shipping, and handling fees.

All transactions are subject to verification and approval, and we reserve the right to refuse or cancel any order if payment is not successfully authorized.

Please review our Privacy Policy to understand how we collect, use, and protect your payment information and other personal data.

Taxes

We will collect applicable sales tax on products shipped to the states and/or regions for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the amount of taxes shown at checkout may be adjusted. Several factors may cause this, such as variances between processor programs and changes in tax rates. 

You are responsible for any duties, tariffs, or other fees imposed by your jurisdiction. 

Returns, Exchanges and Refunds

Due to hygiene and safety reasons, returns are only accepted for unopened, unused products in its original packaging within 14 days of delivery. You are responsible for return shipping costs unless the product was damaged or incorrect. To initiate a return, please contact us at hello@thehairg.com

Refunds will be issued to the original payment method. We reserve the right to deny returns that do not comply with this policy. 

Product Disclaimer 

All products should be used strictly in accordance with their instructions, precautions, and guidelines. You should always check the ingredients for products to avoid potential allergic reactions. Use of the website is not meant to serve as a substitute for professional medical advice: the site is solely an online store for specialty haircare products. Please consult with your own physician or health care practitioner regarding the use of any products or information received from the site before using or relying on them. Your physician or health care practitioner should address all medical questions, concerns and decisions regarding the possible treatment of any medical condition. THE HAIR GENERATION does not give or intend to give any answers to medical-related questions. THE HAIR GENERATION does not represent itself as a physician nor is this implied. No prescription medications or medical treatments are intentionally provided on the website. 

Results may vary per individual. Statements about products have not been evaluated by the U.S. Food and Drug Administration (FDA).

All visual interfaces, graphics, designs, compilations, information, data, computer code (including source code and object code), products, software, services, and all other elements of the website (collectively, the “materials”) are protected by applicable intellectual property and proprietary rights laws.

2. Any conduct or content of any third party on the Website;

3. Any unauthorized access to or use of our servers and/or any personal information stored therein;

4. Product use, misuse, or failure to follow instructions, warnings, or recommendations provided with the product;

5. Delays, interruptions, or errors in shipping, delivery, or fulfillment.

To the fullest extent permitted by law, all products and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no event shall the total liability of The Hair Generation LLC and the Released Parties for all claims exceed the amount you paid, if any, for the product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Governing Law & Dispute Resolution

Without regard to conflict of law principles, these Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any products or services provided by The Hair Generation LLC shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Miami, Florida (unless otherwise mutually agreed) and shall be conducted in English. The arbitrator’s award shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.

Unless we indicate otherwise in writing, by posting or submitting Your Content you grant The Hair Generation LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable (through multiple tiers) license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise exploit such content, including the name submitted in connection with such content, in any media now known or later developed, for any purpose whatsoever.

You acknowledge and agree that:

1. No obligation of confidentiality: We are under no obligation to maintain Your Content in confidence.

2. No compensation: We are not required to provide any payment, attribution, or compensation to you or any third party in connection with Your Content.

3. No obligation to respond: We have no obligation to use, respond to, or return Your Content.

You represent and warrant that:

• You own or control all rights to Your Content;

• Your Content is accurate; and

• Use of Your Content by The Hair Generation LLC does not violate these Terms or infringe upon any rights of a third party.

We are not responsible or liable for the accuracy, completeness, reliability, or legality of Your Content or any Third-Party Content, including errors or omissions, or for any loss or damage incurred as a result of its use. We reserve the right, but not the obligation, to monitor, edit, remove, or take legal action regarding any content at our sole discretion.

Any views, opinions, comments, or other content expressed by third parties or other users on the Website or in connection with The Hair Generation products are solely those of the original authors and do not necessarily reflect our views.
